New Executive Order Allows Under Dining with Certain Requirement

Governor Murphy signed Executive Order 183 allowing the resumption of indoor dining effective Friday, September 4.

Effective at 6:00 a.m. on Friday, September 4, 2020, restaurants, cafeterias, dining establishments, and food courts, with or without a liquor license, bars, and all other holders of a liquor license with retail consumption privileges, collectively referred to as “food or beverage establishments,” are permitted to offer in-person service at indoor areas, provided that the establishment complies with certain requirements. Any retail, recreational, and entertainment business that is authorized to open its indoor premises to the public may allow the consumption of food, beverages, or smoking in those indoor premises, when otherwise permitted by State law. The State-mandated prohibition of smoking in any outdoor areas designated for the consumption of food and/or beverages shall sunset at 6:00 a.m. on Friday, September 4, 2020, although food or beverage establishments may choose to continue this prohibition if otherwise permitted to do so by State law.

The number of individuals at indoor gatherings that are not religious services or celebrations, political activities, wedding ceremonies, funerals, or memorial services shall be limited to 25 percent of the capacity of the room in which it takes place, but regardless of the capacity of the room, such limit shall never be larger than 25 persons or smaller than 10 persons. All attendees at an indoor gathering must wear face coverings at all times except where doing so would inhibit the individual’s health, where the individual is under two years of age, or when wearing a face covering is impracticable, such as when an individual is eating, drinking, or smoking.
